Terms of service (Applicable to All Services)

1. Introduction 

The Service Terms below govern your use of the Service

This document outlines the terms of use for the Vidoc Security Lab (hereinafter referred to as the "Service")The Service has been developed exclusively for use by Vidoc Security Lab partners, prospective partners, media, vendor partners and Vidoc Security Lab employees. By using the Service, you agree to follow and be bound by the following terms and conditions concerning your use of the Service ("Terms of Use"). We may revise the Terms of Use and Privacy Policy at any time without notice to you.

If you do not agree with any of the terms outlined below, you are prohibited from using the Service.

 2. Definitions 

"Service" refers to the platform and set of tools provided by Vidoc Security Lab Sp. z o. o. "You" refers to the individual or entity accessing and using the Service. 

3. User Identity 

You agree to provide accurate and complete information about yourself when creating an account for the Service. You must not impersonate another person or entity, or use a false identity. Misrepresenting your identity is a violation of these Terms of Use and may result in termination of your account and access to the Service.

You will ensure that all information you provide to us via the Vidoc Security Lab Site (e.g., information provided in connection with your registration for the Services) is accurate, complete, and not misleading.

You warrant when using the Service that access to your account will be restricted to only those people expressly authorised by you. You undertake to keep your account login and password confidential. You hereby declare that, in connection with the foregoing, you take responsibility for all actions that will be taken from your account using this login and password. You are obliged to instruct your employees, affiliates and business partners of this aforesaid responsibility.

 4. Prohibited Uses

The Service may only be used for lawful purposes and in accordance with the terms outlined in these Terms of Use. You may not use the Service in any manner that could damage, disable, overburden, or impair the Service or interfere with any other party’s use and enjoyment of the Service.

If You want to use Vidoc Security Lab for scanning, you must have the explicit consent of the owner of the scanned area to perform the scan (the authority authorised to inspect or the owner of the area may request it, Vidoc Security Lab sp. z o.o. is not responsible for verifying the user’s possession of appropriate consent).

You may not transfer outside the Services any software (including related documentation) you obtain from us or third party licensors in connection with the Services without specific authorization to do so.

You must comply with current technical documentation applicable to the Services (including applicable user guides) posted on the VIDOC at https://vidocsecurity.github.io/ (and any successor or related locations designated by us). 

In connection with your use of the Services, you are responsible for maintaining licences and adhering to the licence terms of any software you run. If we reasonably believe any of Your Content violates the law, infringes or misappropriated the rights of any third party, or otherwise violates a material term of the Agreement (including the Service Terms, or the Acceptable Use Policy) (“Prohibited Content”), we will notify you of the Prohibited Content and may request that such content be removed from the Services or access to it be disabled. If you do not remove or disable access to the Prohibited Content within 2 business days of our notice, we may remove or disable access to the Prohibited Content or suspend the Services to the extent we are not able to remove or disable access to the Prohibited Content. Notwithstanding the foregoing, we may remove or disable access to any Prohibited Content without prior notice in connection with illegal content, where the content may disrupt or threaten the Services or in accordance with applicable law or any judicial, regulatory or other governmental order or request. In the event that we remove Your Content without prior notice, we will provide prompt notice to you unless prohibited by law. 

If we are notified of a violation of the law by a user (either by the owner of the scanned area or an inspection authority), the accounts will be terminated.

From time to time, we may apply upgrades, patches, bug fixes, or other maintenance to the Services and Vidoc Security Lab Content (“Maintenance”). We agree to use reasonable efforts to provide you with prior notice of any scheduled Maintenance (except for emergency Maintenance), and you agree to use reasonable efforts to comply with any Maintenance requirements that we notify you about.

a) Interactions with IPs and Devices 

As a user of the Service, you are strictly prohibited from directing the Service to interact with any Ips or devices for which you do not have express authorization. Furthermore, you must not use the Service in a manner that creates excessive or unreasonable load on any Ips or devices. The use of any Service Infrastructure, whether direct or indirect, to initiate, participate in, or attempt any hacking or malicious attacks, or to send bandwidth saturation, damaging or harmful network messages to any device, regardless of ownership, is strictly prohibited. Any violation of these restrictions may result in legal action and may cause harm to the devices and to the reputation of the company.

b) Unlawful Activities 

You must not use the Service for any illegal or unauthorised purpose, including but not limited to the transmission or storage of illegal content or software in violation of intellectual property and copyright laws. 

c) Unauthorised Access

You must not attempt to access or use any portion of the Service that you are not authorised to use, including but not limited to unauthorised access to other computer systems or networks connected to the Service.

d) Unauthorised Target Scanning 

The Service is intended for security scanning purposes. As a user of the Service, you agree to only use the tool on targets for which you have obtained proper authorization. You must ensure that you have the right to scan any targets you intend to scan and must comply with all applicable laws and regulations related to security scanning. Any unauthorised scanning may result in legal action and may cause harm to the targets and to the reputation of the company.

 5. Payments

All payments on our website are made through a third-party payment processor. As such, the third-party payment processor’s terms and conditions, privacy policy, etc., will apply, and it is your responsibility to read any such terms or policies. You will not be able to start using the Service until we have received your payment. We are not responsible for any payment issues with the third-party payment processor.

If we suspect or discover that you are purchasing access to the Service for a purpose contrary to our business and these Terms, we may cancel or put a hold on your purchase.

6. Ineligible Parties 

The Service may not be accessible to certain individuals or entities who meet certain criteria. This includes, but is not limited to, individuals or entities who have been convicted of computer or internet-related crimes, those who are more than thirty (30) days overdue on payments owed to the company, direct competitors of the company, individuals located in regions where the use of the Service is prohibited by law, and those who have previously been refused the Service by the company. If any of these conditions apply to you, you may be ineligible to subscribe to and use the Service.

 7. Intellectual Property Rights

Vidoc Security Lab has a title and full exclusive ownership rights to all copyrights, trade secrets, trademarks, service marks related to the Service and the website. Any Intellectual Property Rights residing in, pertaining to, or resulting from the Service, including all software, technology, and content, are owned and vest in Vidoc Security Lab and/or its licensors, as are all developments and upgrades made to the Service. Except for the limited usage rights specified in the following, you understand and agree that no rights, title, or interest in or to the Service or any related Intellectual Property Rights of Vidoc Security Lab are assigned or transferred to you under this Terms.

The results of the scanning generated under the Terms are your data and shall be owned by you, however excluding any Intellectual Property Rights of Vidoc Security Lab included therein (including but not limited to software, copyrighted works, know-how and trade secrets, such as attack vectors and payloads). You may only use such Intellectual Property Rights of Vidoc Security Lab for the lawful purpose of security scanning, from which the activities listed in clause 4 of these Terms are excluded.

Any suggestions you may have with regard to the operation of the Service, the website or any other Service-related products, in particular as to their improvement or innovation, are the exclusive property of Vidoc Security Lab, irrespective of their author. Except as expressly set forth herein, nothing in these Terms shall be construed as transferring any rights, title or interests in your data to Vidoc Security Lab or any third party.

8. Tools We Use

tawk.to 

Instead of contact via email, contact form or telephone, we offer an alternative, and that is a chat service from the US (USA) provider tawk.to Inc. The Provider provides a backend in which the customer service manager can track which pages are being visited and which country the visitor is from during the session. In addition, the IP address is displayed and therefore the approximate location of the visitor can be displayed. The chat history is also saved. Moreover, via the chat window, the chat history can be uploaded and this conversation saved. If a specific enquiry is made in the chat, then the chat history or a summary of the chat, as well as the personal data provided - as a rule, these are names and at least one contact option - will be stored in our customer database and used exclusively to process your enquiry. The legal basis for the processing is Article 6(1) sentence 1(b) of the GDPR

Auth0 by Okta 

We use the Auth0 by Okta authentication service to log on to our website. The Provider of the service is the American company Auth0 Inc, 10800 NE 8th Street, Suite 700, Bellevue, WA 98004, USA. The Auth0 service uses data processing, also within the US (USA). Processes e-mail addresses, IP address, name and surname, but does not use the personal data provided for its own purposes or pass them on to other companies. Digital Ocean 

DigitalOcean Holdings, Inc. is an American multinational technology company and cloud service provider. The company is headquartered in New York City, New York, US, with 15 globally distributed data centers.

We use the Digital Ocean to complement infrastructure by providing additional cloud services, including hosting solutions, to enhance the platform's performance and accessibility.

Amazon Web Services, Inc. (AWS

Amazon Web Services, Inc., a US entity with registered address at 410 Terry Avenue North, Seattle WA 98109-5210 (United States of America).

AWS provides the cloud infrastructure that supports Vidoc's storage, computing, and networking needs, ensuring scalability, reliability, and data security.

Withholds IP address but does not use the personal data provided for its own purposes or pass them on to other companies.

Stripe 

Stripe, Inc. is an Irish-American multinational financial services and software-as-a-service company dual-headquartered in South San Francisco, California, United States, and Dublin, Ireland. We use it as a payment processor, facilitating secure and efficient financial transactions on the platform. Stripe for payment processes collect, use, and store the following types of data from your financial accounts:

Account owner information, including contact information (such as your name and address);

Account balances, including current and pending balances;

Account details, including your account type and bank, and account and routing numbers;

Account transactions, including balance, transaction date, payee, location, transaction, description, and amount.

Mailerlite 

The Provider of the service is MailerLite, Inc., a Delaware corporation at 548 Market St, PMB 98174, San Francisco, CA 94104-5401, United States.

MailerLite serves as our primary communication tool, allowing Vidoc to send important announcements, service updates, and relevant information directly to the email addresses provided by users during the registration process. Vidoc exclusively utilises user-provided email addresses for communication purposes. We do not share or sell user email information to third parties, ensuring a secure and private communication channel between Vidoc and its users.

Typeform

Typeform, a Software as a Service (SaaS) company based in Barcelona, Spain, specializes in online form building and surveys. Vidoc utilizes Typeform for applications, collecting essential data such as email addresses, names, IP addresses and other information which user input when filling out the form

Planetscale

PlanetScale, Inc.535 Mission St. San Francisco, CA, 94015 United States. As a leading database infrastructure provider, PlanetScale enhances Vidoc's capabilities in data storage and retrieval through its robust and scalable database solution. In the course of our integration, PlanetScale may have access to users' email addresses, names, and IP addresses.

Mixpanel 

Mixpanel Inc. 405 Howard St, #100 San Francisco, CA 94105, USA

Vidoc integrates with Mixpanel, an analytics platform, to gain insights into users in-app behaviour and improve our services. As part of this integration, Mixpanel may have access to certain user data, including but not limited to: IP addresses, applications events, and interactions.

9. Changes to the Terms of Use

 We reserve the right to modify these terms of use at any time and without prior notice. Continued use of the Service constitutes acceptance of any changes to these terms. 

10. Disclaimer 

EXCEPT WHERE EXPRESSLY PROVIDED OTHERWISE, THE SERVICE, AND ALL CONTENT, MATERIALS, INFORMATION, SOFTWARE, PRODUCTS AND SERVICES PROVIDED ON THE SERVICE, ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. VIDOC SECURITY LAB SP. Z O.O.  EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING, BUT NOT LIMITED TO, THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. VIDOC SECURITY LAB SP. Z O.O.  11. Limitation of Liability 

Under no circumstances shall we be liable for any damages arising from the use of the Service, including but not limited to direct, indirect, incidental, special, or consequential damages. 

Vidoc Security Lab will not pay the cost of claims, damages, losses or expenses, including legal fees and costs, caused as a result of incorrect (non-compliant with the above terms of use) use of the Service.

In no event shall the aggregate liability of Vidoc Security Lab, our board of directors, employees, or our affiliates, under, or otherwise in connection with, these terms (including the website and the Service), exceed the total amount of fees actually paid to us by you in connection with the Services provided to you (if any) for the three (3) months immediately prior to the event giving rise to such liability.

A note about children

Minors are not authorised to use the Service and we ask that they do not submit any personal information to us.

12. Indemnification 

You agree to indemnify, defend and hold us harmless, our affiliates and our board of directors and employees from and against any and all third-party claims, damages, lawsuits and causes of action arising out of or in connection with using the Service, or any distribution, publishing, exportation, disclosure, misuse or misconduct undertaken by you, or your fraudulent activity, with respect to scanning results. 

We agree to give you prompt written notice of all claims for which indemnity is sought and to cooperate in defending against such claims, at your expense. You agree to conduct and have sole control of the defence and settlement of any claim for which you agreed to provide indemnification, whereby we reserve the right to conduct our own defence on our own behalf.  

13. Confidential Information

You agree that all Vidoc Security Lab proprietary or confidential information disclosed under these Terms or in connection with your use of the Services and marked as confidential during your use of the Services or that could reasonably be considered confidential or proprietary. Confidentiality obligations apply to information that is not publicly available through authorized disclosure. You may not copy, make transcriptions or recordings or in any other way reproduce or duplicate any document or other medium containing Confidential Information, without our prior written consent.

The provisions of this clause shall not apply to information that is publicly accessible through permitted disclosure, is properly known by you prior to the time of disclosure as demonstrated in writing, is rightfully received from a third party who has the right to disclose it, or is required to be released by law, government order, or request (given that you provide us prior written notice of such disclosure and an chance, in our discretion, to object to such disclosure).

14. Force Majeure

Vidoc Security Lab shall not be liable for any failure to perform its obligations related to the Service or to products linked to the Service due to unforeseen circumstances or causes beyond our reasonable control, including, without limitation, acts of God, war, riot, embargoes, acts of civil or military authorities, acts of terrorism or sabotage, electronic viruses, worms or corrupting microcode, fire, flood, earthquake, accident, strikes, failure of communications or electrical lines, facilities, fuel, energy, labour or materials. 

15. Governing Law 

These Terms of Use and your use of the Service shall be governed and construed in accordance with the laws of the Republic of Poland, without giving effect to any conflict of law provisions. The competent courts in Gdansk, Poland, shall have exclusive jurisdiction. The UN Convention on the International Sale of Goods (CISG) shall not apply to these Terms of Use.

Any dispute, controversy or claim arising out of or in connection with the Service, or the breach, termination, or invalidity thereof, shall preferably be resolved through negotiations between us.
